TERMS OF USE OF THE RMS WEBSITE

1. About these terms

This website, rms-⁠sa.co.za, is operated by RMS -⁠ Reinforcing & Mesh Solutions, a division of Capital Africa Steel (Pty) Ltd (registration number 2003/008668/07) (“RMS”, “we”, “us” or “our”).

These terms apply to everyone who visits or uses this website. By using the website you agree to them. If you do not agree, please do not use the website.

Please read section 12 (limitation of liability) and section 13 (indemnity) carefully. They limit our responsibility and place certain responsibilities on you.

3. Other terms that apply

These terms work together with:

  • our Privacy Policy, which explains how we collect and use personal information;
  • our Cookie Policy, which explains the cookies and similar technologies the website uses;
  • our Online Shop Terms & Conditions, which apply to orders placed through the online shop; and
  • our General Terms & Conditions of Quotation & Sale, which apply to every quotation, credit account and sale.

If one of those documents conflicts with these terms on its own subject, that document applies.

4. Using the website

You may use the website for lawful purposes only. You must not:

  • use the website in a way that breaks any law or infringes anyone’s rights;
  • try to gain unauthorised access to the website, its server or any connected system;
  • introduce viruses, malicious code or anything else that may harm the website or its users;
  • copy or collect content from the website by automated means without our written permission;
  • submit false or misleading information, or someone else’s information, through any form; or
  • use the website to send unsolicited marketing.

We may restrict or block access for anyone who breaches these terms.

5. Information on the website

The information on the website, including product descriptions, specifications, mass tables, images and articles, is general information about our products and services. We take care to keep it accurate and current, but it may contain errors or be out of date, and it may change without notice.

Technical information is a guide only. It does not replace the design, specification or approval of a registered engineer, or the requirements of the applicable South African National Standards (SANS). Please confirm specifications, availability and prices with your branch before you order.

Images are for illustration. Products supplied may differ in colour, finish or appearance.

Prices shown on the website are subject to confirmation and may change. A price becomes binding only as set out in our Online Shop Terms & Conditions or in a written quotation.

6. Calculators and downloads

The calculators on the website give estimates only, based on the figures you enter and standard values. Check every result against your drawings, bending schedules and the advice of a registered engineer before you rely on it.

Documents you download from the website, such as fact sheets and the company profile, are provided for information. They remain our property under section 9.

7. Enquiries and quote requests

Sending an enquiry or quote request through the website does not create an order or a contract. A contract comes into existence only when we issue a written quotation and it is accepted in line with our General Terms & Conditions of Quotation & Sale, or when an online shop order is accepted under our Online Shop Terms & Conditions.

Files you attach, such as drawings and bending schedules, are used only to prepare your quotation and to supply your order.

8. Your personal information

We process personal information in line with the Protection of Personal Information Act 4 of 2013 (POPIA) and our Privacy Policy.

We use the details you send through our forms to respond to you and to provide the products and services you ask for. We send marketing, such as our newsletter, only if you have agreed to receive it, and every marketing email lets you unsubscribe.

9. Intellectual property

The content of the website, including text, photographs, videos, illustrations, animations, calculators, documents and design, belongs to RMS or to those who have licensed it to us. It is protected by the Copyright Act 98 of 1978 and other laws.

The RMS name and logo are our trade marks. You may not use them without our written permission.

You may view, print and download content for your own information or for use on your own project. You may not copy, republish, sell or adapt any content for any other purpose without our written permission.

10. Links to other websites

The website links to other websites and social media platforms, such as Google, YouTube, Facebook, Instagram and LinkedIn. We do not control those websites and are not responsible for their content, availability or privacy practices. Their own terms apply when you use them.

11. Availability and security

We aim to keep the website available and working, but we do not guarantee that it will be uninterrupted, error-⁠free or free of viruses. We may change, suspend or withdraw any part of the website at any time.

We take reasonable technical and organisational steps to protect the website and the information you send through it. No transmission over the internet is completely secure, and you send information at your own risk.

12. Limitation of liability

To the fullest extent the law allows, RMS, its directors, employees and agents are not liable for any loss or damage, whether direct, indirect or consequential, arising from your use of, or inability to use, the website or any information, calculator result or download on it.

Nothing in these terms limits or excludes any right you have under the Consumer Protection Act 68 of 2008 or any other law that cannot lawfully be limited or excluded, or our liability for gross negligence or wilful misconduct.

13. Indemnity

You indemnify RMS against any claim, loss or cost, including reasonable legal costs, that arises because you breached these terms or used the website unlawfully.

14. Electronic communications

You agree that we may communicate with you electronically, including by email and through the website. Under ECTA, a communication by email or through a website form meets any legal requirement that it be in writing.

15. Changes to these terms

We may update these terms from time to time. The version on this page, with its “Last updated” date, is the version that applies. Please check it each time you use the website.

16. Governing law and disputes

These terms are governed by the law of the Republic of South Africa.

If you have a concern, please contact us first so that we can try to resolve it. Any dispute that cannot be resolved by agreement falls under the jurisdiction of the South African courts.

17. General

If any part of these terms is found to be invalid or unenforceable, the rest remains in force.

If we do not enforce a right under these terms straight away, we have not given it up.
